These Terms and Conditions apply when you order hampers or other products from the I Present You website or agree a bespoke hamper with us by email. Please read them before placing an order. They explain who we are, how orders are formed, delivery, cancellations, returns and other important information.
Nothing in these terms limits or removes any rights you have under consumer law.
1. About us
I Present You is the trading name of Present You Ltd, a company registered in England and Wales under company number 17061963.
Registered office and postal address: 375 Tolladine Road, Worcester, England, WR4 9NH.
Email: ipresentyou@icloud.com. Telephone: 07460 166908.
2. Who may place an order
You must be at least 18 years old and legally capable of entering into a contract to place an order with us.
If an order contains alcohol, both the person placing the order and the person receiving the alcohol must be aged 18 or over. You will be required to confirm your age when ordering, and our delivery provider will apply age-verification procedures, which may include a Challenge 25 policy and photographic identification.
You must not order alcohol for delivery to a person under 18 or to a location where delivery would be unlawful.
3. Products and product information
We take reasonable care to describe and display our products accurately. Images are illustrative. Colours, packaging, presentation and the exact arrangement of hamper contents may vary slightly.
Product availability can change. If an item becomes unavailable after you order, we may replace it without contacting you with a suitable product of equal or greater value that is reasonably similar to the original item. We will take account of any dietary or allergen information stated for the order. If no suitable replacement is available, or a proposed change would materially alter the nature of the hamper, we will contact you or provide an appropriate refund.
Product weights, dimensions and quantities are approximate unless stated otherwise. Packaging may change without affecting the product itself.
4. Food, allergens and storage
Our hampers may contain food, drink and products containing allergens. Ingredient and allergen information will be made available before you place an order and will also be supplied with the products where required.
If you or the intended recipient has an allergy, intolerance or other dietary requirement, you must review the product information carefully and contact us before ordering if anything is unclear. For a bespoke hamper requested by email, please tell us about relevant requirements before approving the final hamper specification.
Although we take appropriate precautions, products may be handled or packed in environments where allergens are present. We cannot describe a product as free from a particular allergen unless we have verified that claim.
You and the recipient are responsible for following all storage, refrigeration, use-by, best-before and preparation instructions supplied with the products. Perishable items should be unpacked promptly after delivery.
5. Bespoke hampers ordered by email
You may ask us by email to create a custom-built or bespoke hamper. We will discuss the requested contents, presentation, price, delivery and any relevant dietary or allergen information with you.
Before a bespoke order becomes binding, we will send you a written description or quotation. You must check it carefully, including names, messages, products, delivery details and any requested personalisation. Full payment is required before we begin preparing the hamper. The contract is formed only when we confirm acceptance of the order and payment has been received successfully.
Once we have begun sourcing, preparing or personalising a bespoke hamper made to your specification, you may not have the usual right to cancel merely because you change your mind. This does not affect your rights if the goods are faulty, not as described or otherwise do not conform to the contract.
6. How the contract is formed for website orders
- You select products, provide the required information and submit your order through the website.
- Submitting an order is an offer to buy the products. An automated acknowledgement confirms receipt but does not necessarily mean we have accepted the order.
- We accept the order when we send an order confirmation stating that it has been accepted, or when we dispatch the products, whichever occurs first.
We may decline or cancel an order before acceptance, for example because a product is unavailable, payment cannot be authorised, delivery is not available, information is incomplete, we suspect fraud, or the order would breach a legal or licensing requirement. If payment has already been taken, we will refund it.
7. Prices and payment
Prices are shown in pounds sterling. Present You Ltd is not currently registered for VAT, so VAT is not added to our prices. Delivery charges and any other unavoidable charges will be shown before you submit the order.
We use Stripe to process payments. We do not normally receive or store your complete payment-card details. Payment is subject to Stripe's processing and security checks.
If a displayed price is clearly incorrect, we may reject the order or contact you for instructions before acceptance. We will not charge a higher price without your agreement.
8. Delivery area and charges
We accept orders for delivery within the United Kingdom, subject to the availability of a suitable delivery service for the destination, the contents of the hamper and any carrier restrictions.
Delivery options, estimated times and charges will be displayed at checkout or agreed in writing for bespoke orders. Some postcodes, including remote areas, islands and Northern Ireland, may have longer delivery times, additional charges or restrictions. We will tell you before accepting the order if this applies.
We do not currently deliver outside the United Kingdom.
9. Delivery arrangements
We may use different couriers depending on the parcel's contents, size, destination, value and delivery service. Delivery estimates are not guaranteed unless we expressly agree otherwise.
You must provide a complete and accurate delivery address, postcode, recipient name and relevant contact details. Please tell the intended recipient to expect the delivery, particularly if it contains alcohol or perishable items.
Delivery is completed when the parcel is delivered to the address, handed to the recipient or another person at the address, or left in a safe place in accordance with your instructions or the delivery provider's service. We are not responsible for loss caused by an inaccurate address or unsafe instructions supplied by you, although we will try to help where reasonably possible.
If delivery cannot be completed because no suitable person is available, required proof of age is not produced, access is unavailable or the details are incorrect, the courier may return the parcel or charge for redelivery. We may recover reasonable additional delivery or return costs from you where legally permitted. Perishable products may be unable to be resold or redelivered.
10. Alcohol deliveries
Alcohol will not be supplied to anyone under 18. By ordering alcohol, you confirm that you and the intended recipient are aged 18 or over.
The delivery provider may ask the recipient for valid photographic identification, such as a passport, photocard driving licence or other acceptable proof of age. Alcohol will not be left unattended or handed to a person who cannot provide satisfactory proof of age when requested.
We may cancel or refuse an alcohol order where we cannot complete the legally required checks or where fulfilment would breach licensing requirements. Any refund will be handled in accordance with the circumstances and your statutory rights; reasonable delivery or return costs arising from failed age verification may be deducted where legally permitted.
11. Risk, ownership and delayed delivery
The products become your responsibility when delivery is completed. Ownership passes to you when we receive payment in full and delivery is completed.
We are not responsible for delay caused by an event outside our reasonable control, but we will contact you as soon as reasonably possible and take steps to minimise the effect. If there is a substantial delay, you may be entitled to cancel and receive a refund for products not supplied.
If delivery by a particular date is essential, tell us before ordering. A requested date is not guaranteed unless we expressly confirm it in writing.
12. Checking the delivery and reporting problems
Please inspect the parcel promptly after delivery. If it is damaged, incomplete, incorrect, unsafe, spoiled or not as described, contact us as soon as possible at ipresentyou@icloud.com and include your order number, a description of the problem and photographs where reasonably possible.
Do not consume a product if you believe it is unsafe, contaminated or incorrectly labelled. Keep the product and packaging where safe to do so while we investigate.
Your legal rights apply to goods that are faulty, not of satisfactory quality, not fit for purpose or not as described. Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund.
13. Cancelling an order before dispatch
Contact us immediately if you wish to change or cancel an order. If we have not begun preparing, personalising or dispatching it, we will try to accommodate your request, but we cannot guarantee changes after acceptance.
The statutory cooling-off right does not apply to goods made to your specification or clearly personalised, or to goods liable to deteriorate or expire rapidly. This may include bespoke hampers and certain perishable food products.
A simple gift message will not by itself remove cancellation rights for the other standard, non-perishable goods in an order unless the goods themselves have been personalised or made to specification.
14. Change-of-mind cancellations and returns
For standard non-perishable and non-personalised goods bought online, you normally have 14 days after receiving the goods to tell us that you wish to cancel, followed by a further 14 days to return them.
To cancel, email ipresentyou@icloud.com with your name, order number, the items concerned and a clear statement that you wish to cancel. We will provide return instructions.
You must keep the goods in good condition and handle them only as necessary to establish their nature, characteristics and functioning. You are responsible for return postage unless the goods are faulty, incorrect or not as described. We recommend using a tracked and appropriately insured return service.
For eligible cancellations, we will refund the product price and the basic outbound delivery charge, subject to the law. Extra amounts paid for premium delivery are not refundable beyond the cost of our least expensive standard delivery option. We may reduce a refund if handling has diminished the value of the goods.
We will make the refund within the legally required period, normally within 14 days after we receive the returned goods or you provide acceptable evidence of return, whichever is earlier. Refunds are normally made to the original payment method.
15. Items that cannot normally be returned for a change of mind
Unless faulty, not as described or otherwise required by law, we cannot normally accept change-of-mind returns for:
- goods made to your specification or clearly personalised;
- goods liable to deteriorate or expire rapidly, including relevant perishable foods;
- sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed, where the legal exception applies; or
- any other goods excluded from the statutory cancellation right by law.
This section does not limit your remedies where goods do not conform to the contract.
16. Gift orders
Where an order is sent as a gift, the contract remains between us and the customer who placed the order. The customer is responsible for ensuring that recipient details, dietary requirements and any gift message are accurate and appropriate.
We may communicate with the recipient or courier where reasonably necessary to complete delivery, but refunds and contractual changes will normally be handled with the customer who placed the order.
17. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions, validity dates, product exclusions and minimum-order requirements. Unless stated otherwise, codes cannot be combined, exchanged for cash or applied retrospectively.
We may withdraw or refuse a promotion where it has expired, been used improperly, resulted from an obvious error or is otherwise invalid, without affecting orders already validly accepted.
18. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was formed.
We supply products for private and domestic use. If you use them for commercial, business or resale purposes, we are not responsible for business losses such as loss of profit, revenue, opportunity or goodwill, except where the law does not permit such an exclusion.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that cannot legally be excluded or limited.
19. Your personal information
We use personal information as explained in our Privacy and Cookie Policy. Please read that policy for details of what we collect, why we use it, who we share it with and your rights.
20. Changes to these terms
We may update these terms to reflect changes in law, our products, delivery arrangements or business practices. The terms in force when your order is accepted will apply to that order. The latest version will be published on our website with an updated date.
21. Transfer of rights
We may transfer our rights and obligations under these terms to another organisation, but this will not reduce your rights. You may transfer your rights only with our written agreement, except where the law allows otherwise.
If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right.
22. Governing law and disputes
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you retain the benefit of any mandatory consumer protections that apply to you and may bring proceedings in the courts available to you under applicable law.
Please contact us first so we can try to resolve any complaint. You can reach us at ipresentyou@icloud.com, 07460 166908, or 375 Tolladine Road, Worcester, England, WR4 9NH.
23. Website use
You may use our website only for lawful personal purposes. You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with its operation, scrape it in breach of law or use its content in a way that infringes our rights or another person's rights.
Website content is provided for general information and shopping purposes. We may update, suspend or withdraw website features where reasonably necessary. Product contracts already accepted remain subject to these terms.
